Adam Vitale, a 27-year-old man was sentenced to 30 months in prison for blasting AOL subscribers with spam over a four-month period. He was also ordered to pay AOL, LLC, $180,000 in restitution, according to his attorney, David Touger. He was sentenced in U. S. District Court for the Southern District of New York in Manhattan. Vitale originally faced 11 years in jail and a $250,000 fine for violating the CAN-SPAM Act.

Vitale and his partner, Todd Moeller, were busted after they offered their spam services to a government informant, according to an indictment filed in May 2006.

Moeller told the informant via instant messaging he had 40 different servers to send spam e-mails from and made $40,000 a month from other spam e-mails promoting stocks, court papers said. The spam messages contained false “headers,” meaning the information contained in the e-mail that identified from where it was sent had been faked.

The two also routed the spam through open proxies, or other computer servers, in order to make it more difficult to trace.

The CI offered Vitale and Moeller the opportunity to send spam e-mails that advertised a product the CI purportedly wanted to sell. Moeller and Vitale agreed to do so in return for a 50% cut of the profits, and between August 17, 2005 and August 23, 2005, transmitted spam e-mails to the e-mail addresses of approximately 1. 2 million AOL subscribers.
