Same sex marriage is known as a marriage between two persons of the same biological sex or gender . It is one of the most controversial yet sensitive topics that have been discuss around the world. Politicians are having debates on this subject trying to decide whether it should be legal for same sexes to be married. Same sex marriage is often viewed as being wrong by religious people because marriage is portrayed as a woman and man uniting not woman to woman or man to man. Here in the Philippines, Political parties such as the Gabriela Women’s Partylist are actively lobbying and advocating for lesbian and gay rights and to insist that society not discriminate on the basis of sexual preference.
Unlike in the Philippines there are few countries who are now supporting and allowing same sex marriage including Argentina, Belgium, Canada, Denmark, Iceland, Netherlands, Norway, Portugal, Spain, South Africa, Sweden. The purpose of this study is to advocate the positive effects of legalizing same-sex marriage in the Philippines and to support gays and lesbian people in their rights.
The study will be supported by some research materials. I. Historical Background Here is the short research about Same Sex Marriage regarding both foreign and local literature. A. Short History 1. Foreign Literature The foreign literature contains the views of other countries in legalizing Same Sex Marriage and benefits. Providing same-sex couples with the same legal and social recognition of their relationships in no way infringes upon the rights of others.
Allowing same-sex marriage is about extending the privileges already enjoyed by the majority to an excluded minority who differ simply in terms of the sex of the person with whom they are in a committed relationship. Further, and very importantly, lifting the ban on same-sex marriage is not only about addressing the rights of this minority group; it is about protecting the rights of people in general. If we say exclusion to certain basic privileges is okay for some, then we are opening up the doors to introducing laws as we see fit to exclude others.
In a different space and time, it may be your rights or those of your loved ones that are affected. Equality, respect, dignity, and a sense of belonging are ideals and values endorsed by Australian society. When these values are not upheld for some, it has the potential to affect us all. The lack of opportunity for same-sex couples to formalise their relationships, as do different-sex couples, sends the message that their relationships are not of equivalent standard and that they are second class citizens.
As same-sex sexuality is no more a choice than heterosexuality, restricting marriage to different-sex couples will not stop committed relationships between members of the same sex. What it will do is continue to promote prejudice and intolerance towards a select group of individuals who nonetheless pay the same taxes, fight the same wars, and abide by all other citizenry responsibilities . The lack of opportunity for the gay and lesbian community to legally and socially validate their committed relationships not only affects the couples involved but also their families. Same-sex attracted individuals do not exist on the fringe of society or in isolation. They are someone’s son, daughter, mother, father, brother, sister, aunt, uncle, niece, nephew, grandparent, or grandchild. Having a family member treated differently by the community at large can negatively impact the family as a whole.
Those who argue against same-sex marriage in the name of ‘the family’ seem to overlook the many heterosexual family members that are adversely affected by the social exclusion of one of their own. Local Literature The local literature stated the views of Filipino people in allowing Same Sex Marriage. Addition to that, the rights of homosexual was included here. “Same-sex marriage may be allowed under exceptional circumstances. Art. 6 of the Family Code recognizes as valid in the Philippines those marriage solemnized abroad and are valid there as such, except for marriages forbidden under Art. 38 of the Family Code. ” The argument makes sense because none of the provisions cited — Art. 35(1), (4), (5) and (6) and Art. 36, 37 and 38 of the Family Code — prohibit same-sex marriage. This might lead some couples to go abroad, perhaps New York or some other states/countries that recognize same-sex marriage, and have it recognized here in the Philippines.
While a same-sex marriage is allowed in other jurisdictions, it can also recognized here because it would not hurt anybody and would be a net gain for society. ” (Basilio:2010) On Sunday, the Baguio Pride Network, lesbians, gays, bisexuals and transgender (LGBT) group, celebrated its anniversary by holding a protest action and demanding equal rights. The Baguio Pride Network also called on the government to stop the killings of LGBT members. The group claimed that 104 LGBTs have been killed from January to June of this year.
Meanwhile, Bayan Muna Rep. Teddy Casiño, who attended the event, said his priority right now is to push for the passage of his anti-discrimination bill instead of passing a resolution making same-sex marriage in the country legal. Summary Same-sex marriage is a union between two people who are of the same gender or biological sex.
To sum it all up, the researchers are in favor of finding ways to make same sex marriage legal and hoping to discover the positive effects of having it here in the Philippines. They conducted in this paper the views of both foreign and local people in legalizing it. They found out the countries that advocating and allowing same sex marriage particularly United States, Spain, Canada and Argentina. Also based on the researchers study they had known the reasons why other people especially eligious one are still against same sex marriage simply because they believed God only created man to be united with woman not man to man or woman to woman. Other reason is because gays and lesbian will be more harsh and overconfident on the things that they will do. Also through using research materials the researchers affirms that homosexual community is experiencing discrimination because there voice and rights are being ignored by the Government, but when the time comes that same sex marriage become legal the sufferings they encounter will perish.
So that, the researcher group is still supporting the rights of gays and lesbian to be heard and expecting that others will respect that. They must have the equality they should have and that is the reason that the researchers beg to propose. Conclusion The researchers concluded that when same-sex marriage is legalized in the Philippines the discrimination that gays and lesbian experienced will perish.
There will serve as parents to the children who they adopted and there will be a decrease rate of the homo people who are leaving and transferring to foreign country because they are not welcome and not accepted in our country. There will also be improvement, lots of family that has gay and lesbian member will be happy. Recommendation The researchers recommend this study to use by other researchers as a tool or reference for their study and for the people who wants to learn and gain more knowledge and for them to know what is same-sex marriage, and why should be it legalized in the Philippines.
